We, PYRAMED TELEMEDICINE LLP, a Limited Liability Partnership Firm registered under the Limited Liability Partnership Act 2008 and having its registered office at C 5, Satyam Shopping Centre, First Floor M.G. Road Ghatkopar Mumbai-400077, Maharashtra, India hereinafter referred to as the “Firm” (where such expression shall, unless repugnant to the context thereof, be deemed to include its respective legal heirs, representatives, administrators, permitted successors and assigns).

The Firm ensures a steady commitment to Your privacy with regard to the protection of    your valuable information. This privacy policy contains information about the Website www.pyramed.in, mobile application  “PyraMed” and the http://dashboard.pyramed.in (hereinafter referred to as the “Platform”) (hereinafter referred to as the “Platform”).

In order to provide you with our uninterrupted use of services, we may collect and, in some circumstances, disclose information about you with your permission. To ensure better protection of your privacy, we provide this notice explaining Our information collection and disclosure policies, and the choices You make about the way Your information is collected and used.

This Privacy Policy is in compliance with the provisions of Information Technology Rules, 2011 and Information Technology Act, 2000.

It is mandatory that the User agrees with the terms and conditions of this Privacy Policy in order to continue using the Platform and/ or availing its services.

  1. DEFINITIONS, UNLESS THE CONTEXT OTHERWISE REQUIRES:
    1. “We”, “Our”, and “Us” shall mean and refer to the Firm, as the context so requires. The terms “We”, “Our”, and “Us” have been used interchangeably in this document and reference to one includes the others.
    2. “You”, “Your”, “Yourself”,User”, shall refer to the Patient, Primary Doctor or Secondary Doctor as the context requires. The Definitions for the Patient, Primary Doctor or Secondary Doctor shall be the same as set out in the Terms and Conditions of Use. “You”, “Your”, “Yourself”,User” shall also include a person browsing the Website.
    3. Services shall refer to providing a Platform that enables the Primary Doctor to have a joint electronic / video consultation for the Patient with the Secondary Doctor. The detailed explanation for the same shall be provided in the About Us Section of the Platform.
    4. “Third Parties” refers to any Application, company or individual apart from the User and the Firm.
    5. “Personal Information” shall mean and refer to any personally identifiable information that we may collect from You such as Name, Email Id and Mobile number, and as defined under the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 (“IT Rules”).
    6. Sensitive Personal Data or Information” shall refer to information pertaining to Password, Photo, gender, sexual orientation, details of medical history, medical qualifications, etc. and as defined under the IT Rules.
  1. INFORMATION WE COLLECT

We are committed to respecting your online privacy.

We further recognize your need for appropriate protection and management of any Personal Information and sensitive personal data or information that You share with us.

We may collect the following information:

  1. Model and type of the device, version of the operating system and name of the operating system.
  2. Tracking Information such as, but not limited to the IP address of your device and Device ID when connected to the Internet. This information may include the URL that you just came from (whether this URL is on the Platform or not), which URL you next go to (whether this URL is on the Platform or not), your computer or device browser information, and other information associated with your interaction with the Platform;

We may collect the following information of the Patient: First name, last name, mobile number, email ID, contact address, past medical record, age, gender, present medical details, diagnosis, medication prescribed, management advised from the Patient and with respect to the Patient.

We may collect the following information of the Primary and Secondary Doctors: Name, address, contact number, educational credentials and professional registration details. For the purpose of transfer of the fees/ charges of the Primary and Secondary Doctor, we collect information as is reasonably necessary by the Firm of their banks accounts.

This privacy policy also applies to data we collect from users who are not registered as members of this Platform, including, but not limited to, browsing behaviour, pages viewed, etc.

As a Patient you agree and understand that the data provided by you including but not limited to your medical history, consultation reports and health records would be accessible to the Primary and Secondary Doctors for the purpose of delivering the services through the Platform.

The Users agree and consent that the Platform may monitor or record a consultation, inter alia, for the purposes of quality control and analysis. We shall ensure all reasonable measures to protect such content and prevent any unauthorised third party from accessing the same, but we do not guarantee that our security system is impenetrable.

Where any service requested by you involves a third party, such information as is reasonably necessary by the Firm to carry out your service request may be shared with such third party.

We also do use your contact information to send you offers based on your interests and prior activity and also to view the content preferred by you. The Firm may also use contact information internally to direct its efforts for service improvement. You may have the option to opt out of this through the ‘unsubscribe’ button or through an email to be sent ___________________.

To the extent possible, we provide you with the option of not divulging any specific information that you wish for us not to collect, store or use.

  1. PURPOSE OF COLLECTING INFORMATION

We also collect and store personal/ sensitive personal information provided by You from time to time on the Platform. We only collect and use such information from you that we consider necessary for achieving a seamless, efficient and safe experience, customized to your needs including:

  1. To enable the provision of services opted for by you;
  2. To enable the viewing of content in your interest;
  3. To communicate the necessary account and service-related information from time to time;

However, as a Patient you are aware and you have voluntarily consented us to Use your Personal or Sensitive Personal Information for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes or for sale or transfer of such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates.

We hereby state that we may disclose or transfer User’s personal and other information provided, to a third party as part of reorganization or a sale of the assets of the Firm including the brand or Platform. Any third party to which we transfer or sell our assets to will have the right to continue to use the personal and other information that Users provided to us, in accordance with the Terms of Use and Privacy Policy of the Platform.

Information will be collected via our server logs including users’ IP addresses and the pages visited; this will be used to manage the web system and troubleshoot problems. We also use third-party analytics, tracking, optimization and targeting tools to understand how users engage with our Platform so that we can improve it and cater personalized content according to their preferences.

You have the right to request the Firm to inform you of the purpose of collection of your personal as well as sensitive personal information at any juncture. We will collect and use your information solely with the objective of fulfilling those purposes specified by us or as required by law. We may host surveys for survey creators for our platform who are the owners and users of your survey responses. We do not own or sell your responses. Anything you expressly disclose in your responses will be disclosed to survey creators. Please contact the survey creator directly to better understand how they might share your survey responses.

Information collected will not be considered as sensitive if it is freely available and accessible in the public domain or is furnished under the Right to Information Act, 2005, any rules made thereunder or any other law for the time being in force.

Due to the existing regulatory environment, we cannot ensure that all of your private communications and other personally identifiable information will never be disclosed in ways not otherwise described in this Privacy Policy. It is important that you protect it against unauthorized access of your account and information by choosing your password carefully and keeping your password and electronic device(s) secure by signing out after using our services.

You agree not to use the account, username, email address or password of another User at any time or to disclose your password to any third party.

You are responsible for all actions taken with your login information and password, including fees. If you lose control of your password, you may lose substantial control over your personally identifiable information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password. You agree to notify us immediately if you suspect any consistent unauthorized use of your account or access to your password even after changing it.

Further, transacting over the internet has inherent risks which can only be avoided by you following security practices yourself, such as not revealing account/login related information to any other person and informing our customer care team about any suspicious activity or where your account has/may have been compromised.

Each paragraph of this Privacy Policy shall be and remain separate from and independent of and severable from all and any other paragraphs herein except where otherwise expressly indicated or indicated by the context of the agreement.
